1.2 Any user of the Website shall be referred to as «User», and any user buying services from the Website shall be referred to as «Customer» throughout these terms and conditions.
1.3 Any business terms by the Customer which diverge from these terms and conditions shall not apply, unless expressly confirmed by eScienta in written form.
2.2 COPYRIGHT OF THE WEBSITE AND WEBSITE CONTENT
The website, website content and website design are the property of eScienta. The copyright of the website belongs to eScienta or its licensors. The reproduction, redistribution, or collection of material from this Website is prohibited. Permission to reproduce or redistribute parts of the Website may be obtained by the user in written form only from eScienta.
2.3 WEBSITE ACCESS RESTRICTION
eScienta reserves the right to block or to terminate the User’s access to the website at any time and without prior notice.
2.4 USE of this website
You agree and undertake to use the Site appropriately. By way of example, and not as a limitation, you agree and undertake that when using the Site, you will not:

Conduct or forward surveys, contests, pyramid schemes, or chain letters on the Site;
Post information that threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offense or is insulting any other nation;

The User may link to the website or to the content on the website provided that the linking does not imply any endorsement of any kind of eScienta. eScienta reserves the right to force the User to remove any link pointing to the Website.
You shall not use any hardware or software intended to damage or interfere with the proper working of the Site or to surreptitiously intercept any system, data, personal information, or Content on the Site. You agree not to interrupt or attempt to interrupt the operation of the Site in any manner whatsoever.
The Website may contain advertising. eScienta does not endorse any responsibility of any kind for the content of the advertisement or sponsorship or the advertised product or service, which is the responsibility of the advertiser or sponsor, unless the advertised product or service is offered by eScienta.
2.7 DISCLAIMER OF WARRANTY
There is no warranty for the website and its content, to the extent permitted by applicable laws. eScienta, the copyright holders and/or other parties provide the Website and its content “as is” without representations or warranties of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, satisfactory quality and fitness for a particular purpose relating to the Website, its content or any website to which it is linked. No representations or warranties are given as to the accuracy or completeness of the information provided on the Website, or any website to which it is linked.
2.8 LIMITATION OF LIABILITY
In no event unless required by applicable law shall eScienta, its employees, agents, suppliers, contractors or any other party be liable to the user for any damages of any nature, including any general, special, incidental or consequential damages, loss, cost, claim or any expense of any kind arising out of the use, inability to use, or in connection with the use of the Website, its content and information, even if the user has been advised of the possibility of such damages.
3 Offering of eScienta
3.1 eScienta offers editing and consultancy services, including language editing, journal slelection, pre-submission review, translation, copy editing, manuscript formatting, reference validation and editing, and related services via the Website to natural and legal persons worldwide. Services can be ordered by the Customer from eScienta through the Website, by e-mail, phone or personal communication with eScienta.
3.2 Service packages currently available for purchase and pricing are prominently displayed on the Pricing page of the Website.
4 Ordering and Purchasing of Services from eScienta
4.1 To order and contract editing services through the Website, the Customer must first register with the Website and complete the checkout process.
4.2 The requirement for registering with the Website is that the Customer is of full age and has full legal capacity.
4.3 eScienta accepts the contractual relationship only by confirming the editing services. eScienta may turn down service requests within one business day without further specifying reasons to the Customer.
4.4 When purchasing services from eScienta, the Customer has the following cancellation right:
No cancellation requests will be accepted for confirmed orders.

4.5 When offering services to the Customer, eScienta has the following cancellation right:
Cancellation right: eScienta may turn down service requests within one business day of the receipt of such without specifying any reason and thus cancel the conclusion of the contract. In case of cancellation of the contract by eScienta, eScienta will return the full amount paid by the Customer.

5 Prices, Terms of Payment
5.1 Current prices are stated on the eScienta Pricing page.
5.2 The final price to be paid is shown to the Customer towards the end of the checkout process before payment.
5.3 The Customer will be charged at the end of the checkout process by credit card or other form of electronic payment.
5.4 Alternative payment arrangements have to be concluded between the Customer and eScienta in written form.
6 Contract Document
eScienta makes no provision for a separate contract document based on these terms and conditions. However, the Customer will be offered a formal invoice, which will either be sent to the email address provided by the customer during checkout, or can be downloaded from the user account as a PDF file after ordering services from eScienta, and a payment receipt, which can be downloaded from the user account as a PDF file after the payment has been received by eScienta.
For the purposes of these T&Cs, “Personal Information” shall mean any information that can be linked to a specific individual including without limitation, information such as name, address, telephone number, e-mail address, and credit card details or other financial information that, either directly or indirectly, in combination with other information available or likely to be available, is capable of identifying such person.
You hereby expressly agree and consent to the collection of your Personal Information by eScienta. You hereby agree that eScienta or its agents, may collect, maintain, and process Personal Information about you, your usage of the Site, and related information, that is gathered periodically to facilitate your operation of the Site and to verify your compliance with the T&Cs.
Collection and Maintenance of Personal Information
You note that by using our Site and/or placing any orders for services;
- You agree that if you disclose your Personal Information to us, we may create a database record about you;
- If you register on our Site, make orders, download any materials, or conduct any other transaction, you agree for us to collect any Personal Information necessary to provide you with the service you wish to avail from us;
- You agree that we can contact you with information about products and services that may be of interest to you (unless you have stated you do not wish to receive these communications); and
9 Changes to the Terms and Conditions of Use
8.1 Oxford, United Kingdom, shall be the place of jurisdiction for all legal disputes arising from these terms and conditions, even if the Customer has their domicile outside of the United Kingdom.
10.2 England and Wales law applicable at the place of jurisdiction of eScienta shall apply exclusively.
10.3 If any provision of the terms and conditions should be found to be invalid, this shall not affect the validity of the remaining provisions. In any such case, the contracting parties shall negotiate the invalid clause to establish a valid arrangement that is as close as possible to the original provision.
